Federal Rules of Bankruptcy Procedure (FRBP) Changes for December 1, 2021

On December 1, 2021, changes to four FRBP rules will take effect. We are providing you with a summary of the rule changes as well as the rule changes as they will appear in future publications of the FRBP. A couple of notes on two of the rule changes:

Regarding the amendment to Rule 3007(a)(2(A)(ii), Section 3 of the Federal Deposit Insurance Act, “insured depository institutions” are defined as “…any bank or saving association the deposits of which are insured by the Corporation pursuant to this chapter.” Title 12 USC, Chapter 16 concerns the Federal Deposit Insurance Corporation.

Regarding Rule 9036, Notice and Service by Electronic Transmission, this rule is amended to require “high-volume paper notice recipient(s)” to receive notice electronically. The “top 20” paper notice entities in our district are principally government or corporate entities.

These changes will also be discussed by the Clerk of Court at the Middle District of Georgia Bankruptcy Law Institute Seminar on October 29, 2021.
