The Judges of this Court have recently approved the new Local Bankruptcy Rule (LBR) 7041-1 Dismissing Adversary Proceedings and amendments to LBR 9019-1 Settlements and Agreed Orders Pursuant to FRBP 9019. The new and amended rules are in the latest version of the Local Bankruptcy Rules here.

LBR 7041-1 is added to address the proper manner for dismissal of complaints objecting to discharge under 11 U.S.C. § 727, including in connection with a proposed settlement. There is not a nationally recognized procedure for requesting such dismissals.

LBR 9019-1 is amended because practitioners might be inclined to review LBR 9019-1 Settlements and Agreed Upon Orders Pursuant to FRBP 9019 when contemplating dismissal of an action and the rule is amended to include reference to the new LBR 7041-1.
