In re Jones (Ch. 7, Case No. 01-55087, Adv. No. 02-05025)

The district court determined that the debtor was liable for civil penalties under the Clean Water Act. The civil penalties arose from the discharge of oil into a navigable water and the failure to have a spill prevention plan to prevent and control oil pollution. The bankruptcy court determined that the debtor's obligation for civil penalties which may be imposed for violations of the Clean Water Act were nondischargeable under 11 U.S.C.A. ยง 523(a)(7).
