Amended Order on Attorneys' Fees in Chapter 13 Cases

The Judges of this Court have issued Administrative Order 2024-01, "Amended Order on Attorneys' Fees in Chapter 13 Cases (Superseding Administrative Order #147 Dated October 6, 2022)," effective February 1, 2024. Please note the Court's new Administrative Order numbering protocol, which uses the year issued and sequence number of the order.

The new administrative order authorizes the Chapter 13 trustee to disburse to the debtor's attorney the lesser of $2,340.00 or six (6) times the monthly plan payment, less any attorney's fees paid prior to confirmation, to reflect inflationary increases since the last increase. Additionally, after completion of disbursements to the debtor's attorney as authorized above, the trustee is authorized to disburse the balance of any remaining attorney's fees under the debtor's plan in an amount not to exceed the less of $156.00 or 40% of the monthly plan payment excluding any current house payment in the plan.
