Unclaimed Funds

Unclaimed funds are funds held by the Court for an owner or recipient who is entitled to money, but who has not claimed ownership.  Most unclaimed funds arise when dividends (assets) are distributed by the case trustee to creditors pursuant to settlement of a bankruptcy case, but the property goes unclaimed.  All unclaimed funds paid into the Court pursuant to 11 U.S.C. Section 347(a) shall be deposited in the United States Treasury.

Pursuant to 28 U.S.C. 2042, any claimant entitled to any unclaimed funds held by the court may, on petition to the court and upon notice to the United States Attorney and full proof of right thereto, obtain an order directing payment to him. A petition requesting unclaimed funds may be filed by the owner of record, a successor in interest, or a representative claimant.  Please click below for access to the forms and instructions.
