Credit Reporting
The Bankruptcy Court has no jurisdiction over credit reporting agencies. The Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681, is the U.S. Federal Government legislation enacted to promote accuracy, fairness, and privacy of consumer information contained in the files of consumer credit reporting agencies.
The United States Bankruptcy Court for the Middle District of Georgia does not report information to any credit agency. Court records are public, however. Any individual or organization with a login to the Public Access to Court Electronic Records (PACER) system can access bankruptcy court records online to obtain information about your bankruptcy case. Credit agencies are able to obtain information through these online records.
If any information the court has is incorrect, an action should be filed requesting the court to evaluate whether that information in the court’s records is inaccurate. However, whatever information is in the possession of credit reporting agencies is not connected with any reporting activity done by this court.
