Public Notice Regarding Proposed Amendment to Local Bankruptcy Rule 5005-4(a) and Abrogation of Local Bankruptcy Rule 7001-1
The Judicial Council of the United States (JCUS) will publish changes to the Federal Rules of Bankruptcy Procedure (FRBP) on December 1, 2024. Two local rules will be affected by the new rules.
Local Bankruptcy Rule 5005-4(a) on Electronic Filing is amended to conform the local rule to the renumbering as a result of the JCUS initiative on restyling the FRBP. There is no substantive change to our local rule.
Local Bankruptcy Rule 7001-1, which allows debtors to recover an automobile or an item of consumer goods repossessed by a creditor to be accomplished by a contested matter rather than an adversary proceeding, is to be abrogated as redundant to the new FRBP 7001, which now allows for the same procedure.
